SPONSORS
The Contest is sponsored by BY THE LIGHT PHOTOGRAPHY, LLC with an address of 107 Paugusett Circle Trumbull CT 06611. (hereinafter referred to as the “Sponsor”).
ELIGIBILITY
The Contest is open to legal residents of the continental United States however travel by the photographer is limited to 25 miles of Trumbull, CT. Additional travel of the photographer including all expenses incurred is the sole responsibility of the winner. This Contest is void outside the continental United States, including Alaska, Hawaii and Puerto Rico and wherever prohibited by federal, state or local law. You must be twenty-one (21) years of age or older as of 4/08/2010 and have a valid United States driver’s license to enter this Contest and be eligible to win. All U.S. Federal, State and Local laws and regulations apply.
Employees, officers, directors, agents and representatives of the Sponsor, and their parent companies, subsidiaries, affiliates, advertising and promotion agencies, and the immediate family members of each of the above and/or those living in the same household are not eligible to participate. Sponsor reserves the right to verify the eligibility of each Winner. Only one entry per household.
HOW TO ENTER
No purchase necessary, a purchase will not increase your odds of winning. Visit the Contest entry page at http://www.ByTheLightPhotography.com. Online entrants are subject to all notices posted online, including but not limited to privacy policies. You will be asked to provide your first and last name, mailing address, e-mail address, daytime phone number and age. You will also be asked to confirm that you have read and agree to these Official Rules. You may also be asked to answer optional questions; however they need not be answered in order to be eligible for the Contest. Sponsor reserves the right to cancel this Contest or modify these Official Rules with immediate effect at any time prior to the closing date of the Contest, by advertising that fact on http:/www.bythelightphotography.com, or by disseminating such information via email. All entries and the information contained the entries will become the Sponsors’ property and will not be returned or acknowledged.
By participating, entrants consent to receive notification of future promotions, advertisements or solicitations by or from Sponsor via email, direct mail or other means of communication. You may opt out of such communication by following the directions in any email received.
CONTEST PERIOD/DEADLINES:
The Contest online entry period opens on 04/08/2010 at 12:01 am/EST and will close on 04/30/2010, at 11:59 pm/EST.
SELECTION AND NOTIFICATION OF WINNER:
A winner will be drawn at random using a random number generator from eligible entrants adhering to the following guidelines:
The presumptive winner will be notified by e-mail or phone on or about 05/01/2010 The presumptive winner will be required to respond to the winner notification by e-mail, mail, or phone within five (5) calendar days. The presumptive winner will also be required to sign and return a model release and contract. The return notification of selection as a winner as undeliverable or failure to timely and completely return the model release and contract will result in disqualification and the Sponsor, in their sole discretion may select alternative winner by the methods described above. In the event of a dispute, the decision of the Sponsor shall be final and binding.
GRAND PRIZE
ODDS OF WINNING DEPEND ON THE NUMBER OF ELIGIBLE ENTRIES RECEIVED. The winner (“Winner”) will receive a two hour photo session within 25 miles of Trumbull CT 06611 and $75 of print credit towards purchasing photographic prints from the Sponsor. Additionally discounted products will be offered to the Winner at the discretion of the Sponsor. No transfer or substitution of prizes is allowed. The prizes may not be redeemed for cash, and there is no cash value. The prizes cannot be used in conjunction or combined with any other competition or offer, nor may they be transferred or exchanged. The Sponsors reserve the right to substitute the prize or any portion thereof for one of equal or greater value for any reason at their sole discretion. Any travel outside of 25 miles from Trumbull CT 06611 is the responsibility of the Winner as are any and all taxes, fees, duties, and expenses incurred during travel by either the Winner of the Sponsor. Travel will be at the discretion of the Sponsor and a substitution may be made for the photo session if at the Sponsor’s discretion travel is not feasible. The photo session and all other offers expire three months from the close of the contest. All taxes are the sole responsibility of the Winner.
GENERAL TERMS AND CONDITIONS
By participating, entrants agree to be bound by these Official Rules, and waive any right to claim ambiguity in the Contest or these Official Rules. All federal, state and local laws apply. All federal, state or other tax liabilities arising from this Contest will be the sole responsibility of the Winner. The Sponsor and each of their parent companies, affiliates, subsidiaries and advertising and promotions agencies are not responsible for and shall not be liable for: (i) late, lost, delayed, misdirected, incomplete or unintelligible entries, telephone system or computer malfunctions, lost connections or transmission errors; (ii) any injuries, losses or damages of any kind caused by the acceptance, possession or use of any prize or from participating in the Contest; (iii) any printing, typographical, administrative or technological errors in any material associated with the Contest; or (iv) any damage to entrant’s or any other person’s computer network, software, hardware or other telecommunications malfunctions related to or resulting from entering into this Contest or downloading any material from the Sponsor’s website. The Sponsor reserves the right, at it’s sole discretion, to modify, cancel or suspend this Contest should a virus, bug, computer problem or other causes beyond the Sponsor’s control corrupt the administration, security or proper play of the Contest. In the event of a dispute concerning the identity of an on-line entrant, entry will be declared made by the authorized account holder of the email address from which the entry was submitted. “Authorized account holder” is defined as the person assigned to an email address by an Internet access provider, on-line service provider or other organization responsible for assigning email addresses at the time the entry was submitted. The Sponsors may prohibit you from participating in the Contest or winning the grand prize if, in their sole discretion, the Sponsors determine that you are attempting to undermine the legitimate operation of the Contest by cheating, hacking, deception, or other unfair playing practices or intending to annoy, abuse, threaten or harass any other players or Sponsor or their representatives. CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND WILL RESULT IN DISQUALIFICATION OF ENTRANT AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSORS RESERVE THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY’S FEES) AT LAW AND EQUITY FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION. Acceptance of the prize will constitute permission for the Sponsors to use the name, city, state and voice of the winner for advertising, editorial, publicity and promotional purposes by Sponsors throughout the world, in perpetuity, in any media now known or hereinafter developed, without any further compensation, notification, review or approval, except where prohibited by law. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsors in connection with the Contest, shall be governed by, and construed in accordance with the laws of the State of Connecticut without giving effect to any choice of law or conflict of law rules, which would cause the application of the laws of any jurisdiction other than the State of Connecticut. In addition, any dispute relating to the Contest (including these Official Rules) shall be brought in the appropriate state or federal court having jurisdiction over the subject matter located in Fairfield County Connecticut. Entrants hereby irrevocably consent to the personal jurisdiction of said courts and waive any claim of forum non conveniens or lack of personal jurisdiction they may have.
LIMIT OF LIABILITY AND DISCLAIMERS
ENTRANTS RELEASE AND HOLD SPONSOR, EACH OF THEIR PARENT COMPANIES, AFFILIATES, SUBSIDIARIES, AGENCIES, ASSIGNS AND/OR ANY OTHER PERSON OR ENTITY ASSOCIATED WITH THE CONTEST HARMLESS FROM AND AGAINST FROM ANY AND ALL CLAIMS, LOSSES, LIABILITIES, EXPENSES OR INJURIES OF ANY KIND RESULTING IN ANY WAY FROM CONTESTANT PARTICIPATION IN THE CONTEST, INCLUDING BUT NOT LIMITED TO, THE DRAWING, THE USE OF THE PRIZE, ANY DELAYED, LOST, MISDIRECTED, OR DAMAGED ENTRIES, OR ANY COMPUTER, ONLINE SERVICE, COMMUNICATIONS OR OTHER TECHNICAL MALFUNCTIONS THAT MAY OCCUR.
ALL CONTESTANTS ACKNOWLEDGE THAT THE SPONSOR, THEIR PARENT COMPANIES, AFFILIATES, SUBSIDIARIES, AGENCIES, ASSIGNS AND/OR ANY OTHER PERSON OR ENTITY ASSOCIATED WITH THE CONTEST MAKE NO WARRANTY OF ANY NATURE, EXPRESS OR IMPLIED WITH RESPECT TO THE PRIZE, WHETHER FOR FITNESS FOR A PARTICULAR PURPOSE, SATISFACTORY QUALITY, DESCRIPTION OR NATURE OF THE PRIZE OR OTHERWISE. ALL CONTESTANTS, BY ENTERING THE CONTEST, AGREE TO BE BOUND BY THE ABOVE RULES.
